Promotional Period

Start Date: 01/01/2016
End Date: Ends in each Participating Venue at close of business on 31/01/2016 or once gift stocks are exhausted, whichever is first to occur.

Eligible claimants

Gift claim is open to all people. Claimants under 18 years old must have parental/guardian approval to claim a gift and further, the parent/guardian of the claimant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor submitting a gift claim in this promotion.

How to claim a gift

To claim a gift, a claimant must purchase any two products within the Blackmores Superfood range, in one transaction, from any Chemist Warehouse or My Chemist (“Participating Venue”) within Australia which displays advertising for this Promotion (“Qualifying Transaction”).

Gift stocks are limited. Claimants should confirm whether gift stocks are available at the Participating Venue prior to completing their Qualifying Transaction.

Limit one (1) gift claim permitted per Qualifying Transaction.
Limit of one (1) gift permitted per person.

Terms and Conditions

1.The claimant agrees and acknowledges that they have read these Conditions of Entry (and Schedule) and that claiming a gift in this Promotion is deemed to be acceptance of these Conditions of Entry (and Schedule). Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless otherwise stated.

2.The Promotion commences on the Start Date and ends on the End Date ("Promotional Period").

3.Employees (and the immediate family members) of the Participating Venue, the Promoter, its distributors, suppliers and associated companies and agencies are not eligible to enter. Valid and eligible gift claims will only be accepted during the Promotional Period. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4.The offer will be valid while gift stocks last. Every valid claim during the Promotional Period will receive an Australian Open official merchandise sports water bottle valued at RRP $15. Stock of gifts in the Participating Venue are limited. The gift will be awarded at the point of purchase (i.e. at the point of completing the Qualifying Transaction). If a claimant does not request and collect their gift at the point of purchase, they will forfeit their right to the gift. If a gift is unavailable, the Promoter reserves the right to substitute the gift with a different gift of equal or similar value, subject to any written directions of a regulatory authority.

5.Claimants must retain their receipt/s for all Qualifying Transactions as proof of purchase. Failure to provide the proof of purchase when requested by a staff member at a Participating Venue or the Promoter may result in forfeiture of a right to a gift, or a gift already awarded may need to be returned to the Promoter or a Participating Venue.

6.If any claimant chooses not to take their gift (or is unable to), they forfeit the gift and the Promoter is not obliged to substitute the gift.

7.The value of the gift is accurate and based upon the recommended retail value of the gift (inclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the gift after that date.

8.If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any gift claim.

9.The Promoter reserves the right, at any time, to validate and check the authenticity of claims and claimant’s details (including a claimant’s identity, age and place of residence). In the event that a claimant cannot provide suitable proof, the claimant will forfeit the gift in whole and no substitute will be offered. Claims relating to incomplete purchases, failed payment transactions, or returned Big M product/s will be deemed ineligible for a gift.  

10.The Promoter reserves the right to disqualify claims in the event of non-compliance with these Conditions of Entry. In the event that there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each claimant and no correspondence will be entered into.

11.Nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

12.The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence or wilful misconduct) in connection with this Promotion or accepting or using any gift (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

13.The Promoter accepts no responsibility for any tax implications and the claimant must seek their own independent financial advice in regards to the tax implications relating to the gift or acceptance of the gift.

14.Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights
