The following constitute an agreement between you and Blackmores Limited (ABN: 35 009 713 437) (“Blackmores”, “we” or “us”), the operator of the Blackmores website www.blackmores.com.au
By purchasing goods via this Site, you signify that you agree to these Terms of Purchase, the Additional Terms, and you consent to resolve in the State of New South Wales, Australia any dispute that you may have with us, the Site, or any purchase or attempted purchase of goods or services by you via the Site.
2. Changes to these Terms of Purchase
We may change these Terms of Purchase at any time, as we deem appropriate. If we make changes we will let you know by noting on the Site that the Terms of Purchase have been updated. If you disagree with the changes to these Terms of Purchase, discontinue your use of the Site to purchase goods via the Site. Your ongoing purchase of goods or services via the Site after the changes take effect signifies your agreement to the new terms. We encourage you to review the Terms of Purchase regularly, including before each purchase made via the Site. If you are paying for goods as a recurring order through Blackmores Subscribe (as described in clause 4), we may change the the Terms of Purchase of the recurring order, by notifying you, and giving you the option to modify your next order with 14 days notice. If you do not modify or cancel your next order, we will assume that you agree to the updated Terms of Purchase.
3. Ordering goods
The range of goods offered over the internet directly from Blackmores is sourced from Blackmores' Australian range of products (products sold in stores in other countries may differ from this range). Any order placed by you in the manner described on this Site is an offer by you to purchase a particular product at the advertised price (including delivery costs and other charges) specified on this Site at the time you place your order.
Orders are only accepted online and while stock lasts. You acknowledge that, by placing your order, you are agreeing to pay for and accept delivery of the goods ordered. Where an order has been placed under Blackmores Subscribe as a recurring order, you are agreeing to pay for and accept delivery of goods in accordance with the terms of your recurring order unless you modify or cancel your recurring order under your account profile settings and we send you written confirmation via email of the cancellation prior to the goods being dispatched to you.
There is a transaction limit of $500.00 per order. This limit may change from time to time without notice to you.
Blackmores may change the prices published on this Site at any time. Prices of products placed in the 'shopping cart' but not paid for are also subject to change and you agree to pay the price current at the time of payment.
While every effort has been made to ensure the accuracy of prices and information displayed on the Site and related website pages, Blackmores reserves the right to accept or reject your payment offer for any reason, including without limitation, the unavailability of any product, an error in the price or the product description posted on the Site, or an error in your order, or we reasonably believe you have not complied with these Terms of Purchase or the Additional Terms, or we have previously refused to accept any order(s) from you.
We may require additional verification or information before accepting any order. Verification required will be determined by us.
In Australia and in all other countries, we reserve the right to limit sales, including the right to prohibit sales to re-sellers.
We are not responsible for typographical or photographic errors on this website, including any such errors in relation to prices.
4. Blackmores Subscribe
In the absolute discretion of Blackmores, we may offer certain goods to be ordered on a recurring basis after a certain number of weeks as specified by you, whereby you agree to purchase a number of goods at a certain price (“Blackmores Subscribe”). In this case, Blackmores will take the payment from your credit/debit card or your nominated PayPal account after every number of days (the number of days will be based on the Blackmores Subscribe period selected by you), and then dispatch the goods to you, until such time as we, or you, cancel the Blackmores Subscribe service.
You can modify or cancel your Blackmores Subscribe service by login into your account and either modifying or cancelling your recurring order at least 3 business days prior to when your next payment is due to be paid. In addition, we will email you 7 days prior to your next order being due to notify you that your next order is about to be processed. To modify or cancel your Blackmores Subscribe service, please log into your account and go to Blackmores Subscribe, select the order that you wish to modify or cancel and update as necessary. If we do not receive the modify or cancel request within 3 business days prior to your next payment date, we reserve the right to dispatch the goods in accordance with your original Blackmores Subscribe request and take payment from your nominated credit/debit card or PayPal account, and then cancel your Blackmores Subscribe recurring order.
We may cancel your Blackmores Subscribe recurring order at any stage, including without limitation, when we no longer sell the goods, or we reasonably believe you have no complied with these Terms of Purchase, or we wish to change the price for those goods within your Blackmores Subscribe recurring order, or we attempt to take payment from your nominated financial institution and it is refused in more than one occasion, or we notify you of a change to these Terms of Purchase and you notify us within the 14 day period that you do not accept the new Terms of Purchase. If there are any price changes in relation to the products included in your Blackmores Subscribe recurring order, we will notify you in advance via email.
If we, or you, modify or cancel your Blackmores Subscribe recurring order in accordance with the above we will no longer charge your credit/debit card or PayPal account, and will attempt to advise you by email in advance.
It is your responsibility to ensure your details are correct, including email, shipping delivery and payment details. We take no responsibility if goods are delivered to the wrong address or payment is not accepted, because you failed to update your details. As we will be informing you of any changes or updates to your Blackmores Subscribe recurring order via email, it is your responsibility to ensure that an active and valid email address is recorded in your Blackmores account at all times. Notwithstanding the above, Blackmores does not assume any responsibility for any delays on non-receipt of emails due to technical issues.
In addition to these specific terms and conditions that apply to goods purchase through Blackmores Subscribe, all of the other Terms of Purchase apply.
5. About our prices
Product availability may vary between Australian retail stores and Blackmores' website due to different retailer offers. For deliveries within Australia, all prices are inclusive of the Australian Government's Goods and Services Tax (GST), currently set at 10% of the price of all products, but subject to change. For deliveries to destinations outside of Australia, GST is removed. Prices displayed on this website are current at the time of issue, but may change at any time and are subject to availability. Prices and availability of items are subject to change without notice. Products are sold for personal use only.
6. Blackmores account payments
Payments to Blackmores can be made by Visa, Mastercard, PayPal and Blackmores Gift Cards (please see terms and conditions
that apply when using Gift Cards) only. Unless otherwise specified, the price payable for goods ordered is the price specified on this Site, plus any applicable shipping and handling charges. Prices are inclusive of GST for Australian deliveries and exclusive of GST for all products shipped outside Australia
Each purchase will be shipped as a separate order and cannot be combined. Whenever possible in Australia, Sydney, Melbourne and Brisbane orders will usually be delivered within 5 days of ordering. Adelaide, Hobart, Perth and all regional areas within approximately 7 days. Blackmores cannot guarantee delivery times, including due to reasons beyond Blackmores control. All deliveries are made Monday - Friday via Australia Post. You have the option to authorise Australia Post to leave your package at the delivery address by ticking the ‘authority to leave’ box during checkout. There are no weekend deliveries.
For purchases over AU$70.00 standard delivery is currently free in Australia. For purchases under AU$70.00, a flat delivery fee of AU$8.00 currently applies for standard delivery.
For international orders deliveries are sorted and shipped via air freight to the handling centre within your country and then delivered by your country's postal service. You agree that Blackmores is not responsible for, and has no control over, the local postal service in your country. You agree that Blackmores cannot be held liable for any shipping issues, delays or errors originating from within your country.
A flat delivery fee of AU$25.00 currently applies to all international deliveries outside Australia. Delivery fees are subject to change without notice.
When ordering from Blackmores, the recipient is the importer of record and must comply with all laws and regulations of the destination country. Orders that are shipped to countries outside of Australia may be subject to import taxes, customs duties and fees levied by the destination country. The recipient of an international shipment may be subject to such import taxes, customs duties and fees, which are levied once a shipment reaches your country. Additional charges for customs clearance must be borne by the recipient; Blackmores has no control over these charges and cannot predict what they might be. Customs policies vary widely from country to country and region to region; you should contact your local customs office for further information. When customs clearance procedures are required, it can cause delays beyond our original shipment delivery estimates.
Blackmores reserves the right not to deliver goods to certain countries. Please check the Purchasing FAQS for further details. Blackmores is also not responsible for assuring the product can be lawfully imported to the destination country. When ordering from Blackmores, for delivery outside Australia, you or the recipient of record must comply with all laws and regulations of the destination country. Accordingly, you should check any import laws or regulations that would restrict the importation of the goods prior to purchase.
8. Returns policy
We do not accept returns for simply changing your mind after purchase, unless we otherwise specify, such as where you cancel your order before we dispatch the goods, and we send you confirmation of the cancellation via email. Despite the above, nothing in these Terms of Purchase alter any rights you may have under the Australia Consumer Law. Please ensure you retain proof of purchase of purchasing products from our Site and the goods in question if you are looking at returning your goods. and ensure you include your six digit order number which was emailed to you upon processing of your order.
All refund payments will be processed in Australian Dollars and Blackmores will not be held liable for any difference in the value of the refund against the initial purchase price in the final currency you used to purchase the products. Blackmores will not be liable to refund any fees or charges you incurred from your credit/debit card provider for your initial purchase.
9. Safe arrival
All products are boxed using protective cushioning for safe arrival. If there is any damage to the package content - please ensure you include your six digit order number which was emailed to you upon processing of your order. We may request that you provide us with a picture of the damaged goods.
10. Title and risk
Title to the goods purchased on this Site does not pass from Blackmores to you until we have received payment in full for the goods.
11. Disclaimer of warranty
Blackmores is providing this Site and its contents on an 'as is' basis and use of this website is at your own risk. The content is believed to be accurate, complete, current and reliable at the date the information was placed on the website. Blackmores and its related companies, affiliates, licensors or licensees, and their respective directors, officers, employees or agents make no representation or warranty as to the accuracy, completeness, currency or reliability of the information contained on this Site (including in relation to any products or services). To the extent permitted by law, including any non-excusable statutory obligations (including under the Australian Consumer Law), none of them will be liable or responsible in any way (including in negligence) for errors in, or omissions from, the information contained on this Site. To the extent permitted by law, Blackmores expressly disclaims all warranties of any kind, whether express or implied, including (without limitation) implied warranties or conditions of merchantability or fitness for purpose.
Your ability to purchase goods from this Site may be terminated by Blackmores at any time without notice. All restrictions, licenses granted by you and limitations of Blackmores' liability will survive termination.
